Congressional Democrats oppose EPA chemical recycling rule change



A group of 50 Democratic lawmakers in Washington sent a letter to Environmental Protection Agency Administrator Lee Zeldin on June 18 hoping to block changes to emissions rules for chemical recycling sought by Zeldin and the plastics industry.


The effort, led by Sen. Jeff Merkley, D-Ore., and Rep. Jared Huffman, D-Calif., urged EPA to not change Clean Air Act regulations for pyrolysis chemical recycling plants and instead keep them under rules for solid waste incinerators.


Zeldin has been in a public campaign to change pyrolysis regulations, issuing an EPA news release in late April and testifying before Congress, arguing that new rules are needed to attract more investment for pyrolysis plants as a way to boost plastics recycling.


The agency in March opened a formal rulemaking asking if it should make that change, but Zeldin’s public statements are ahead of where the agency is. Officially, it’s not proposed specific new regulations but raising the plastics idea within a larger rulemaking on incinerators for disaster zones.


The letter from the Democratic lawmakers argues that the agency should focus on traditional mechanical recycling technologies for plastics. It said chemical recycling facilities emit toxic pollutants.
